Jeezus, what a bloody day

I got in an accident today. I'm fine, the other person is fine. i'm just rattled, and unhappy, and annoyed, and embarassed.

I was pulling out of work onto Rt 28 to go to lunch. I prepared to turn into the right-turn-only lane and from there to merge into traffic. I looked and everything seemed clear. there might have been another car in the right-turn-only lane, but it seemed some distance away and i believed that it was going to make a turn. so i turn, and before i complete my turn there's a bit SUV coming at me, i yank the wheel to the right to get away, she hits my side front, i go up on the curb and hit a city sign. the woman gets out of the car and, in intelligible spanish, begs me "No polizia, no polizia." i tried to get information from her, but was stymied by her lack of english. The police arrive almost immediately, come to find out she doesn't have a driver's licence, and its her boyfriend's car. My car isn't drivable, and Geico couldn't guarantee a tow as soon as the police wanted it, so the cops called a tow themselves and took my car to the storage lot until Geico could come get it.

[shakes head] what a damn pisser. who would expect someone to be fucking *traveling* in a turn only lane?! unfortunately that's not illegal, so i'm at fault, dammit. I got charged with, admittedly, the lowest charge the trooper could give me which was "Failure to Yield Right Of Way". she has to go to court for "Lack of Operator's Licence." I've got things set up with Geico, they've already gotten me a reservation with Enterprise, that i have to call tomorrow, as it's after their business hours. i need to call the trooper tomorrow to find out who Geico needs to contact about the city sign. I've already expressed a concern to them about them possibly dropping my coverage. I don't *think* they will, but you never know. i had a small fender bender two months back, but other than that i've had no claims for the past 2 years i've been with them. I also don't know if i'm going to have to get another car or not. the Saturn may be so damaged that its not worth repair, considering it's 10 years old. We'll see.

Good thoughts, please? I sorely need them.

I'm so sorry, but glad to hear that everyone is OK. May the paperwork flow smoothly so you can put this behind you soonest.

Glad to hear you're OK. (Josh tells me GEICO totalled out the car for more than it's worth, so that's something.)

I would strongly recommend that you go to court and fight the ticket. Tell the judge that although you saw another vehicle approaching in the turn lane, it was a turn-only lane, and you sincerely believed that the other vehicle was preparing to turn and that you therefore had plenty of time to pull out. Make sure you point out that the other driver had no license, and that you cannot be certain whether she was the other vehicle you saw in the turn lane or whether she'd pulled into the turn lane as you began your turn.

This is one of those situations where the officer is technically required to write the ticket, but when presented with the full facts of what happened, a reasonable judge will must likely dismiss the citation. (Speaking from personal experience.)
